SMS Compliance
An important step in successfully using SMS marking for your business. Improper use of SMS marketing can cause customers to block you and result in fines. Make sure your messages are complaint for your area, and read below for some guidance.
Business SMS is an incredibly powerful tool as it gives you access to your customers personal space (their text message inbox). However because of that, many agencies throughout multiple governments have enacted some pretty basic rules that must be followed in order to legally gain the right to send your customers text messages. Below is a summery of what is required in order to stay compliant as of 10/26/2021:
Customers must opt in
- They can do this by:
manually checking a box on a website that says something to the effect of “I agree to receive text messages from [COMPANY]”
Verbally agree to the opt in. An example of this would be mentioning it at the counter when they are registering for a rewords program.
Texting an SMS keyword or shortcode to a designated number
Customers must be allowed to opt out

You must provide a message about what your SMS program will include. This can be done through Titanly by editing your “Compliance Message” in your settings. This message is sent out immediately when someone joins your group. The message must include:
Your business name.
What kinds of messages your customer can expect.
Approximate rate at which your customer will receive messages.
Text message and data rate disclaimer.
Opt-out instructions.
Recommended: Link to your terms and conditions.
Recommended: Link to your privacy policy.
You must not text customers before 8 AM or after 9PM
Texting consumers/customers that did not give authorization can cost you fines from $500 - $1500 per incident.
In general you need to be mindful of how you use this powerful tool. Not just because the law says so, but because you don’t want to have your customers opt out because they are annoyed. But if you take your time and think through what you are doing, you shouldn’t run into any issues.
